عمومى ، مثل نهادهاى كيفرى و مدارس - [ كانون اصلاح و تربيت ] - ، ممنوع شده است يا خير ؟ » « 1 » علاوه آن كه ، كميته به كشورهاى عضو پيشنهاد مىدهد مفاد مادّهى 19 را به عنوان اساس و پايهاى براى وضع قوانين و معيارهاى ديگر عليه مجازات بدنى كودكان برگزينند . « 2 »
ب ) بند 2 مادّهى 28
از ديگر مواردى كه از زمانهاى گذشته در مدارس هميشه عادت بوده و به كار گرفته مىشده ، استفاده از مجازات و تنبيه بدنى در امر آموزش و تعليم و تربيت كودكان است . قاطعانه مىتوان بيان داشت مادّه 19 كه تنبيه بدنى كودكان را به طور مطلق منع مىكند ، تنبيه بدنى كودكان در مدارس توسط معلّمان را نيز ممنوع مىداند . علاوه بر اين ، از بند دوم مادّهى 28 كنوانسيون حقوق كودك نيز اين معنا به خوبى قابل استفاده است . اين مادّه بيان مىدارد :
« كشورهاى عضو ، مىبايست كليه اقدامات مقتضى را جهت تضمين اينكه انضباط در مدارس مطابق با شأن انسانى كودك و مفاد پيماننامه حاضر اعمال مىشود را معمول دارند . » « 3 »
