2 . كنوانسيون ملل متّحد در مورد حقوق كودك « 1 »
از ميان اسناد متعدّد و مختلف نظام بينالملل حقوق بشر كه براى ممنوعيّت مجازات بدنى كودكان شناخته شدهاند ، پيماننامه حقوق كودك جامعترين مورد براى چنين تفسيرى است .
اين كنوانسيون كه اساس تفكّر بينالمللى براى بهبود ، حمايت و تأمين منافع كودكان است ، در 20 نوامبر 1989 م توسط مجمع عمومى سازمان ملل متحد تصويب شده ، و تاكنون 192 كشور بدان پيوستهاند و فقط دو كشور سومالى و ايالات متحده آمريكا مقاومت كرده و آن را نپذيرفتهاند . « 2 »
با اين حال ، مىتوان گفت : مفاد كنوانسيون حقوق كودك و قسمتهاى وابسته به آن ، در مواردى كه مورد اجماع و يا به طور كلّى ، مورد پذيرش كشورها قرار گرفته ، به صورت قاعده بينالمللى عرفى در آمده « 3 » و حتّى براى كشورهاى غير عضو
